Abstract:

Juridical regulations regarding transplant bioethics have also appeared in the Romanian legislative frame since years 90s. Moreover, the first correlations of health policies to the bioethics principles have made their debut. From the legislative resourcesí point of view, the main bioethical landmarks of human dignity are offered by the EUís legislation and the ECHRs jurisprudence, which thus offer a stable support but reduced dynamic regarding the organization of health policies on bioethical grounds. Currently, there is no clear differentiation between bioethics fields in the Romanian practice, both with regards to the professional organization as well as regarding the medical specializations.

Incepand cu anii 90 au aparut si in spatiul legislativ din Romania reglementari legale privind bioetica transplantului si de asemenea au debutat primele corelari ale politicilor de sanatate cu normele bioetice. Din punct de vedere al resurselor legislative, principalele repere bioetice pentru definirea demnita tii umane sunt oferite de legislatia UE si de jurisprudenta CEDO, care ofera astfel un suport stabil dar cu o dinamica redusa In ceeea ce priveste organizarea politicilor de sanatate pe baze bioetice. In prezent, In activitatea practica rom‚neasca de multe ori nu exista o diferentiere foarte clara Intre domeniile medicinei legale si cel al bioeticii, at‚t in ceea ce priveste organizarea profesionala c‚t si cea specialitatilor medicale.
